Overview

Drafted by a committee under president Kais Saied and approved by referendum July 25, 2022 on about 30 percent turnout, the Tunisian constitution replaced the 2014 text. It creates a hyper presidential system with parliament reduced in oversight, the judiciary under executive influence, and removes the 2014 clauses on parliamentary confidence. It defines Tunisia as a civil state with Islam as religion but drops 2014 language on womens equality commitments drawing critique. The 2024 elections occurred under its framework. It is the counterexample within the same country to consensus constitutionalism of the 2014 kind.
